Aird & Berlis Successfully Obtains Certificate of Pending Litigation and Restraining Order Injunction in Residential Dispute
Earlier this year, the Superior Court of Justice released its decision in Paladino Excavating Inc., et al. v. Paladino et al., 2023 ONSC 4397 regarding a residential tenant dispute between a father and his son. Aird & Berlis represented the son and successfully obtained a Certificate of Pending Litigation and an injunction preventing the father from attending a property where he does not reside, but for which he is the registered owner, plus $48,000 in costs of the motion. The underlying proceedings involve a number of broader and more complex issues relating to the operation and ownership of a family-run construction business.
The Divisional Court subsequently dismissed the father's motion for leave to appeal the injunction order.
