Tim is an experienced litigator with extensive involvement in municipal-related disputes. He has acted for several municipalities in a variety of matters, including contractual disputes, litigation relating to procurement, challenges to by-laws for illegality and bad faith, expropriation proceedings, and payments in lieu of taxes. He is a thoughtful and nuanced advocate, always mindful of the public nature of his clients and their issues. Tim understands that his clients’ matters are often urgent and, accordingly, ensures he is sensitive to his clients’ needs.
He is a member of the firm’s Litigation & Dispute Resolution Group and a member of the firm’s Executive Committee. Tim's wide-ranging civil litigation practice includes general commercial litigation, corporate proceedings and shareholder disputes, municipal-related litigation, all manner of real estate disputes, franchise litigation, construction litigation, insurance litigation and professional liability cases.
Represented Homestead Land Holdings Ltd. in connection with two proposed high-rise buildings in downtown Kingston at an Ontario Land Tribunal Hearing and successfully resisted a motion for leave to appeal at the Divisional Court.
Represented the City of Stratford in the expropriation of the former Grand Trunk Railway lands in Stratford. The OLT found entirely in favour of Stratford in assessing the market value of the expropriated lands.
Represented Charlesfort Developments Ltd. in a case against the City of Ottawa regarding a land use planning matter related to a new condominium development. Charlesfort was wholly successful in this proceeding and awarded nearly $4.5 million in damages and pre-judgment interest.
Represented the Region of Durham in successfully reaching a settlement with the City of Oshawa regarding a 12-year legal battle arising from the amalgamation of Durham Region Transit services.
