Samantha draws on her strong attention to detail to provide pragmatic solutions for her clients. She enjoys the fast-paced and high-stakes nature of restructuring and bankruptcy matters.

Samantha is a member of the firm’s Financial Services and Litigation & Dispute Resolution Groups. Her practice focuses on bankruptcy and insolvency proceedings involving mid-market and large cap companies. She represents creditors, debtors and court-appointed officers. Samantha’s work encompasses a broad range of insolvency proceedings, including asset sales and recovery, security enforcement and restructuring litigation.

Samantha is passionate about community involvement and has extensive experience working with grassroots, pro bono and international human rights organizations.

Representative Matters

Successfully represented Nautilus Fitness Canada, Inc. in its application for the appointment of a receiver in its receivership proceedings.

Represented the Chief Restructuring Officer, HWS Consulting Inc., in Peoples Trust Company v. Crown Crest Capital Management Corp. et al.

Represented BMO, as secured lender, in the Tokyo Smoke CCAA proceedings.

Successfully represented RBC in Royal Bank of Canada v. 2531961 Ontario Inc. et al., where the Court appointed a receiver over the Respondents’ assets due to repeated delays, lack of transparency and failure to provide sufficient evidence of refinancing efforts.

Counsel to KSV as the proposal trustee following 125 Ferris Inc.’s filing of an NOI under the Bankruptcy and Insolvency Act.

Successfully represented RBC in Royal Bank of Canada v. Express GT Parts Serve Inc. et al., in which the Court held that RBC’s security interest extended to the collateral of a related entity after the original borrowers were voluntarily dissolved.

Counsel to Tandia Financial Credit Union Limited in connection with the receivership application of a group of gas and retail companies. 

Counsel to a cannabis conglomerate with a cumulative deficit of $527.8 million during proceedings under the Companies’ Creditors Arrangement Act.

Counsel to a First Nations wholesale fuel supplier in civil litigation to recover and freeze misappropriated assets, including a megayacht moved offshore by a former executive, as well as restructuring proceedings under the Companies’ Creditors Arrangement Act with total liabilities of approximately $100 million.
