Max is a member of the firm’s Litigation & Dispute Resolution Group. He is a fierce advocate, whose practice covers a range of litigation matters, including securities, construction and product liability. Max has particular experience in civil and regulatory proceedings against directors and officers, broker/dealer disputes, and class actions.

Max has acted as lead counsel before all levels of court in Ontario and has represented clients before courts in Alberta, British Columbia, and Quebec, and numerous administrative boards and tribunals, including the Ontario Securities Commission. He has significant class actions defence experience representing both domestic and multinational clients. 

Max is a sessional instructor at the University of Windsor Faculty of Law, where he teaches a course on white-collar crime. He also volunteers as Duty Counsel with the Ontario Securities Commission Litigation Assistance program, assisting unrepresented litigants facing OSC proceedings, and as Duty Counsel for the Holland Bloorview Pro Bono project, representing families denied government benefits in proceedings at the Social Benefits Tribunal.

Representative Matters

Represented a U.S. airline class actions commenced in multiple jurisdictions in Canada in which plaintiffs allege that the defendant airlines conspired to limit the increase in capacity in the airline industry in order to drive higher prices and higher margins.

Represented a U.S. airline in class actions commenced in Ontario on behalf of all persons who purchased a ticket for trans-Atlantic or trans-Pacific air travel. The plaintiffs allege that the defendant participated in worldwide price=fixing conspiracy in relation to fuel surcharges that were applied to airline tickets. The plaintiffs have claimed approximately $200 million in damages.

Represented a Taiwanese manufacturer of LCDs in class actions commenced in Ontario and B.C. on behalf of direct and indirect purchasers of LCDs. The plaintiffs alleged that the defendants participated in a worldwide price fixing conspiracy in relation to LCDs. The plaintiffs claimed approximately $150 million in damages. The claim has been settled.

Represented the former auditor of YBM Magnex in two class actions commenced by primary and secondary market investors for approximately $360 million. The plaintiffs alleged that YBM Magnex was used to carry out a multi-layered conspiracy and fraud for several purposes including obtaining improper gains by financial statement misrepresentation and manipulation. The actions were settled by all defendants prior to certification.

Successfully obtained an injunction in a dispute regarding a family-run trucking and logistics business.

Advised The Green Organic Dutchman Holdings Ltd. (CSE: TGOD), a sustainable Canadian cannabis company and producer of premium, organically grown cannabis, in completing the acquisition of BZAM Holdings Inc., a privately-owned producer of flower and 2.0 products.

Acted as Ontario counsel to Premier Parks LLC in connection with EPR Properties’ US$142 million acquisition of the Village Vacances Valcartier resort and hotel in Quebec City and Calypso Waterpark in Ottawa, Ontario, and the simultaneous leasing of the properties to Premier Parks.

Advising Infrastructure Ontario and the Ontario Ministry of Transportation in connection with the Highway 427 Expansion Project.

Advising Humber River Hospital in connection with a major P3 development project.
 
Represented a Canadian subsidiary and its parent company in tobacco litigation, including a class action in Quebec and various healthcare cost recoupment actions initiated by provinces against tobacco manufacturers.
 
Represented the former CEO of one of the world’s largest engineering, procurement and construction companies in billion-dollar class actions in Quebec and Ontario.
 
Represented one of the largest conventional oil and natural gas producers in Canada against shareholder class actions in Ontario, Alberta and Quebec.
 
Represented a mining company and two of its former directors and officers in a class action relating to alleged misrepresentations surrounding one of the company’s mining properties.
 
Represented the manufacturer of a leading food brand in a high-profile dispute regarding permits and imports.
 
Represented a party before the Ontario Securities Commission on allegations of illegally distributing securities contrary to the Ontario Securities Act, resulting in withdrawal of all allegations.
 
Represented various litigants facing Ontario Securities Commission proceedings as part of the Ontario Securities’ Commission Litigation Assistance Program.
 
Represented various investment advisors and banks in civil and regulatory enforcement prosecutions relating to allegations of unsuitability, misrepresentations and oversaturation of complex financial products.
 
Represented municipalities against personal injury claims.
