In November 2024, Ontario introduced significant amendments to the Construction Act (the "Act") through the Building Ontario for You Act (Bill 216). These changes aim to assist the construction industry by improving payment processes and access to adjudication, as well as bringing clarity to the Act itself.
While the changes are not yet in effect, getting a head start on understanding the rights and responsibilities under the updated Act is crucial for all industry participants to ensure compliance and prevent potential pitfalls in their construction contracts.
Topics include:
- Holdback requirements (including mandatory annual holdback release) and lien provisions
- Invoicing and prompt payment
- Interim adjudication
- Transitional provisions and housekeeping amendments
